These Terms of Use (“Terms”) govern your access to and use of privatenoir.com (the “Site”), operated by PrivateNoir. By using the Site, you agree to these Terms. If you do not agree, do not use the Site. These Terms are intended to allocate risk fairly; they are not a promise that you can never bring a claim, and they do not override mandatory consumer protections that apply where you live.
Acceptance
Accessing or browsing the Site constitutes acceptance of these Terms and our Privacy Policy.
Age requirement
The Site is for adults only. You confirm that you are at least 18 years old and of legal adult age in your jurisdiction (whichever is higher). If you are not, leave immediately.
Content nature
Site content features AI-generated fictional adult characters. Characters are not real people. We do not endorse or represent that images depict real individuals. No real-person likenesses are intended. Teasers on this Site may be restrained; fuller sets may appear on the linked membership platform.
Intellectual property
Site text, branding, layout, and media (unless otherwise noted) are owned by PrivateNoir / the operator or used under license. You receive a limited, revocable, non-exclusive license to view the Site for personal, non-commercial use. You may not scrape the Site for AI training where prohibited, republish member or teaser content, or remove notices. Unauthorized commercial reuse is forbidden.
Third-party Fansly
Paid memberships are billed by Fansly (or another linked platform). Fansly’s terms of service govern purchases, cancellations, refunds, and account issues. PrivateNoir is not Fansly. Billing: https://fansly.com/benayahu.
Prohibited uses
- Access by minors or facilitating access by minors
- Harassment, threats, or abusive contact
- Reverse-engineering or misrepresenting content as depicting a real person
- Illegal use, fraud, or attempts to bypass platform payment or access controls
- Automated scraping for model training or bulk republication where prohibited
DMCA / likeness complaints
If you believe content infringes copyright or depicts an unauthorized real-person likeness in a way that harms you, email hello@privatenoir.com with enough detail to identify the material (URL or screenshot), your contact information, and a good-faith description of the issue. We will review good-faith reports and may remove or modify content where appropriate. This process does not admit liability.
Disclaimers
The Site is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
Limitation of liability
To the maximum extent permitted by applicable law, PrivateNoir and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site. Where liability cannot be excluded, it is limited to the greater of (a) amounts you paid us directly for Site access in the 12 months before the claim (typically none, since billing is via Fansly), or (b) USD 50 — unless mandatory law requires otherwise. Nothing in these Terms excludes liability that cannot legally be limited (for example, certain personal injury or fraud claims where such exclusions are void).
Governing law
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and without prejudice to mandatory consumer protections in your place of residence.
Changes
We may update these Terms by posting a revised version on this page with a new effective date. Material changes should be reviewed before continued use.
